My question involves a mortgage in the state of: north carolina
i purchased a home contract for deed. i did not go through a lawyer. (yes, it was stupid). when i purchased the home in the contract the seller/owner did not disclose he had a loan on the property. Of course, safe act of nc clearly states that it must be present. having said that, im currently in a law suit rescinding the contract. i received a copt of the "loan" contract to my home that the owner/seller took out on my home in march 2015. i have lived in the house since october 2012. he has taken 3 loans (refinance) on my home. he also has a va loan in which he is the sole person on the deed/mortgage. he has never been in the military. since the loan was taken out in 2006 and his present wife is/was not in the military, how did he get the VA loan and how can he refinance home with a va loan? i have no way of telling on the original mortgage if it was a va loan, but the copy i got of his recent transaction is a va loan. my lawyer sent me paperwork to sign in a fraud case for 'posing" as a veteran. i am assuming because of the va loan on the home, my lawyer is having me sign servicemembers civil relief act affidavit. my questions are......... is there a way he can get a va loan on a home without being a veteran or being married to one? what is a va rider? can he refinance the loans under a va loan? i do realise he has to live in the residence to qualify. obviously he lied. several times. this is my problem. he has now refinanced the home and maxed it out on value. He owes more than i do on the loan. there are several more areas of fraud, but this is particulary on this va loan thing. In the state of nc. on a recision of contract he/owner/seller he entitled to fair market rental value for the entire time we have been in the home. I think this is wrong due to several fraud actions, loans on the home as his primary residence, claiming his federal and state taxes as his primary home, etc... please help... the last thing i want is to file a suit with this servce member fraud if thats not the case with a va loan and look like an idiot.
