My question involves business law in the state of: MA/Massachusetts
The situation was like this:
I was at an event in a mall. It was essentially a sort of pawn shop, except for specific things and with a big crowd of people that play games and socialize over it.
The event was hosted by a business of course, that sells product. I was there playing with the rest of the people and selling a similar product (many people were)
The business people there came to me and told me I had to leave, under the fact that I was breaking the law since
1) I am selling product without a business license
2) I am selling product without paying the state tax
**important note: I am not a business. Only a citizen for now, making deals similar to ones that occur on craigslist or similar sites.**
The true reason they kicked me out, presumably, was that I was costing them a few profits by doing some deals there as well. I understand well they have every right to kick me out of their store with or without reason. That is not in question
My questions are:
1) Is what they said truly illegal? For example, if I buy or sell a 20$ item on craigslist (obviously without a license or tax) is that technically illegal? The form of buying and selling that occurred all over the event was that kind, not any formal business meeting or swap. Later on I did my deals in essentially the same form as one would do on craigslist. Not even on their property or store.
2) I left their store, but they told me to leave the entire mall and threatened to get the police if I didn't. (I complied just in case but I am wondering on specifics) Are they allowed to do that?
Can one company inside an entire mall (they do not own the mall) legally kick you from a place such as a mall? (since it is not theirs to govern). They saw me in a nearby area that their business was not involved with and that's where the bigger threats started coming out.
3) Can he detain me at all for it? I left his store and went to another part of the mall as i said. Can he detain me there as well? Since he tried to.
In other words, was he right about everything including action? Or what?
