My question involves estate proceedings in the state of: OH
I searched, but could not find an answer to this exact scenario. My grandparents passed away a few years back and left a sizable estate to be divided by their three children. However, one of the children died before my grandparents, and the will was changed to give the two grandchildren a third of the estate. The estate involved a lot of land, and has only now begun to be settled. Another issue delaying the settlement is that my father and his brother, the surviving children of my grandparents, don't get along very well. They have gotten through most of the property, but have reached an impasse regarding the rest. Now one of the grandchildren is threatening to sue my father if he does not agree to the terms of his brother. The two grandchildren have had no say in anything up to this point, and merely received distributions of money once property was sold. Do they have any standing to sue my father? I initially said no, but now am not sure. The silly thing is is that 80% of the estate has been settled and distributed to them, and the complaining grandchild is probably going to isolate themselves over not a whole mess of money.
