My question involves landlord-tenant law in the State of: Arizona
I have a 2 year lease and a purchase option for the house, currently 1 year in the lease. The common area has a 3 acre park with pool and 2 story water slide, that requires a keyfob for access.
The HOA payments are behind $1,600 and the HOA has the option to foreclose on the property after $1200 behind.
Now here is the complicated part on the backstory prior to me renting the property.
Homeowner entered into agreement of sale (4 years to make payments balance due at end of term) with Party 1
Party 2 signed agreement taking over Party 1 rights in agreement with homeowner
Party 2 is the party I signed the lease and purchase option with
Party 2 is in default on his contract with the land owner for not paying the HOA
Any suggestion about how to go about this?
I was going to sue the Party 2 / my landlord for failure to provide common area access and seek rent abatement and damages
Is there anyway to enforce the contract between party 2 and landlord if I'm not a party to that contract?
Is there anyway to invalidate my contract with Party 2 based on the fact they are in default of the contract with home owner?
