My question involves a consumer law issue in the State of California.
My husband and I have bought a lot to build a residential home on. One of the neighbors rear deck is falling apart. One of the legs supporting it has broken off and 3-4 panels of the wooden fence have fallen off onto our lot. Our lot slopes down a good 3-5 feet from his back yard.
The retaining wall has also been sliding down the hill slowly over many years, our property slopes upwards. The same neighbor also has an empty pool and the concrete around the pool has major cracks.
My husband went to talk with him about the issues as we will begin excavation and building soon and dont want to chance anymore collapsing of the deck. We were hoping he would take the opportunity to use our lot to fix his deck now while there is nothing on the property. The neighbor seems like he may be in his 80s and may have some memory problems.
We are wondering if there is anything we can do with this matter before we start excavating. In the meantime were trying to find a way to get in contact with some relatives of his that could help.
