My question involves real estate located in the State of: new York
(over 30 years ago my husbands family bought property that had access to a season use road.) me and my husband took over the property over 25 its been paid off years ago. at one time my husbands uncle who still owns the land next to us allowed us to go thru his property. But he started telling us who could and couldn't come to our property, so we stopped using his way in and went back to the season use road.
We also had a some one to the other side of us, who at one time my husband did work for and they had a good relationship with. But he transferred his property to his son, and started buying all the land around us. He wanted ours also he started with 10,000 he went up to 40,000 and we started really thinking about it. Til he got together with the uncle on the otherside of us, and started closing all roads leading to the property saying he owned it and we were land locked.
we ended up going to court and they had to give us access which happened. In the decree it was written all trees taken down in the easement would be ours we were to make the easement road. (with no time line) though because the surveryor made errors on the easement and he wouldn't respond to us. it took longer to get to this step. also in the decree as long as they were good neighbors the would have right of first refusal to buy if and when we were ready to sell. also with a 150.00 limit as to what we were willing to pay for insurance, which is now going up over that.
Now the easement is off a road registered as a road on google which we were able to get an address for. Now we are told by them at they own the road?
We had trees logged off our property and logs taken from the easement road and they say, because the trees were placed on the road that they own them. The police say we are with in our right but the Dec say that the road and trees are there's, the logger wont take them and they don't want them? I really need to know what to do?
