My question involves court procedures for the state of: CA
The defendant claim to have a contract or statement from the previous owner that exempt them from their obligation. I asked to examine the "contract" but was denied. I filed a small claim case in California. I filed a form CS-105 with my small claim complaint motion form the to produce the contract or statement I want to see the what they are talking about before trial.
The defendant have not responded to the motion at all. Can I get a default on the motion (form cs-105) and if so when (how long do I have to wait).
