Financial Exploitation: Elder Law

My question involves a person located in the state of: MASSACHUSETTS


My sister has the power of attorney over our mother's estate. Our mother is at a nursing home (long term) and got approved for Medicaid. My sister has been responsible for our mother's checking account in which our mother receives social security benefits every month. Then my sister writes a check to the nursing home (patient pay amount) every month.

For the past two months, the nursing home has not deposited our mother's patient pay amount checks - my sister called and was told that everything is all set. She was also told that we had to keep the amount of money in our mother's checking account under a certain amount every month or our mother would not be eligible for Medicaid anymore. So, my sister bought stuff such as new TV, blankets, clothes, etc...for our mother using that money.

Two days ago, she got a letter from the nursing home saying that my mother owed two months' worth of patient pay amount but that money is already spent. Now, the nursing home is threatening to report our mother to social security.

What does that mean and what will happen to our mother? What will happen to my sister? She had no idea that she was not supposed to spend any money. She was told to keep the checking account under a certain amount every month in order to keep our mother eligible for Medicaid.
