I recently lost a civil case and now I am judgment debtor. I have a job from which I get salary from an employer and also a bank account on my name.
I understand that, to garnish my salary, as per § 77.03, Florida Statutes, the creditor needs to file a motion for garnishment and I have chance to file my reply and then the Court decides on this matter. Therefore, it is my belief that I knew when my salary garnishment starts. Is it true?
To garnish money from my bank account, does the Plaintiff needs to file a motion as he did for garnishing my salary or can he get judgment lien certificate, in accordance with Section 55.203, Florida Statutes, with the Florida Department of State and then garnish the money from my bank account?
Does the creditor need to inform me prior to getting judgment lien certificate, in accordance with Section 55.203, Florida Statutes?
