Breaking a Lease: Verbal Agreement Between Landlord-Tenant to Dissolve Lease, Now He Won't Cooperate

My question involves landlord-tenant law in the State of: Minnesota

Hi there,

Last month, my boyfriend and I signed a six month lease for a new place. The landlord offered us $300 off rent per month if we were to do cleaning around the building and mow the lawn. I asked the landlord to include this agreement in our lease, but he refused and we went along with it because it was a good deal for us and he seemed like a good guy (I know, a classic young adult mistake). A few weeks after we moved in, the landlord informed us that he had changed his mind and was going to go with a contractor to do the cleaning and mowing. We had not received any warning that our performance was not up to his standards, and no formal rules about the frequency of cleaning/mowing had been established.

I was obviously frustrated by this, so I called the landlord to ask him to give us another chance with the cleaning/mowing. He became kind of aggressive with me (and made some sexist comments about how I wasn't able to push the lawn mower), but eventually offered to let us out of our lease given the circumstances. I told him I would be in touch.

Earlier this week, my boyfriend and I decided to take him up on this offer and left him a voicemail giving our 40 day notice. We have since put in an application at a new apartment for July. Now, our current landlord is refusing to take our calls, has not acknowledged verbally or in text that he agreed to dissolve the lease, and is also refusing to fix some maintenance issues (we have no heat) because we have "already wasted enough of his time and cost him enough money." He asked us to send written notice "requesting" to be let out of the lease, but did not acknowledge that he had already stated that we could do this.

We sent him a termination of lease agreement in the mail today, but I fear that he is going to drag this out forever. I want to speak with him on the phone, but also don't want to make him angry given that 1) he's proven to have a temper, 2) we have no written agreement that he is not holding us to our lease, and 3) he has a massive security deposit from us.

I don't know what to do! Any legal/practical advice would be greatly appreciated. Thank you so much in advance!!!!
