My question involves a consumer law issue in the State of: Florida
Recently, I was going to evacuate in the evening due to a hurricane. When I got into my car to leave town the car was having issues. The next morning I took my car to the dealership for service. They said that they could not have it ready until the next day due to having to order a part. So they had me take a loaner car with the intention of me only using it that one day. When I came back the next morning to have the part installed the wrong part was delivered so they could not install it. They kept my car hostage due to the hurricane which was due to hit here on Sunday. They were closing that afternoon and would not reopen until the middle of the next week. They just said to take the loaner car to evacuate. So under duress and without any recourse, I left in the loaner car and left town.
On the road that evening while I was driving another car sideswiped me. It was the other driver's fault, but he did not have insurance. My insurance will not cover the accident because I did not have collision coverage. I only have liability and uninsured motorist coverage. The damage was not so bad that I could not continue with my travels. Now, the dealership's insurance claims wants me to pay for the damage.
My question is: do I have any recourse? I realize that I might be able to file a suit against the driver of the other vehicle. What I want to know is this. Does the dealership bare any responsibility? My car was not ready in the time promised, so I was forced to use the car provided. Since the circumstances were in a situation where there was an emergency do I have a case?
