I am the stepmother of the 11 y/o that I am asking about. My husband has a really good job that requires to him to travel for around 250 days of the year. He doesnt have a set schedule, and I really dont know when he is coming home until about a day before hand.
His ex-wife and him just had a hearing and judgement regarding visitation, and it has turned into a really ugly battle. She showed up in court with the daughter, unannounced. The current order is e/o weekend at this time. She is scheduling events with her church and activities on his weekends, and then getting upset when we say no, and want to see the daughter. Because of this, she is now going to motion (3rd motion in 2 months) for the First Right of Refusal as she knows he works out of town, and this will prevent the daughter from visiting by at least half for the year.
I have been in this little ladies life since she was four, we have step and half siblings in our house related to his daughter. My husband and I have been married for 6 years and together for 7. We have an established relationship, and we all love her. She has even emailed my husband saying that the daughter will be going to an event on his weekend in May, and he doesnt have a say as she will have the FROR by then.
We plan on fighting it. I know this law was written to allow for more possible visitations, rather than using it agains the other parent and their family. How big of a chance is there, that this will get passed, and I will lose seeing her everytime he is gone?
