My question involves a traffic ticket from the state of: CA
I was driving late night on a highway with a posted speed of 55MPH when I ran the red light and was pulled over by CHP and issued a ticket ($450 min). Immediately I had a feeling of being set up. So few days later, I returned to the same intersection armed with a stop watch and timed how long the yellow light lasted. I timed between 2.95 to 3.05 sec after several tries. According to the California Vehicle Code (CVC), the yellow light must stay lit a minimum of 5 sec when speed limit is 55MPH. So they purposefully shortened it by nearly 2 whole seconds!!!!!! I timed other lights on the same stretch of the highway and they were around 5 sec.
Due to this new evidence, I am thinking about hiring a lawyer who intends to first fight it with "Trial by Written Declaration" and if that fail, will fight it in court. Or should I just skip the lawyer fees and represent myself since the video evidence and CVC regulation speak for themselves? I mean the judge has no choice but to dismiss it since it's blatant disregard for the state law, right?
