Establishing an Order: Custodial Parent Who Had Emergency Temporary Custody Passed Away

My question involves a child custody case from the State of: Texas

Posting for a family member. My family member lost custody of her child several years ago. Emergency temporary custody was given to the child's biological father in the state of Oklahoma due to an open DHS investigation/case. The father relocated to Texas and the mother now lives out of state as well. Contact was ceased and my family member could not afford to hire an attorney to fight for visitation. DHS cases involving child are closed. Custodial parent has now passed away. Child is with grandparents. How does my family member go about re-establishing custody or has custody automatically defaulted to her being the biological parent? If it has then how does she obtain proof of custody in order to get her child?
