My question involves a traffic ticket from the state of: New Jersey
I was at traffic court all set for my trial, but it got rescheduled as the Prosecutor requested a reschedule as his witness (the P.O's) didn't turn up!!! this is after waiting a full 20 minutes
After the judge ordered the trial be rescheduled, the Prosecutor wanted to take a look at my evidence so he can prepare for the trial
We (my friend had come over to the court) went over to the Prosecutors office and I showed him a few of the drawings and photos. He asked some questions on which direction I was driving and what some of the items I had drawn on the sheet meant - I gave as little information as possible
While we are wrapping up and when the evidence was still on the table, the police officer (who ticketed me) along with the decoy officer + 1 more P.O (I was ticketed for not stopping for pedestrian, during a decoy operation) walked in. The Prosecutor told them that the trial was being moved to another day; after a few more minutes of the prosecutor doing most of the talking, we took our evidence and walked out.
My court date has now been set for mid March. My questions are:
1. Can the judge decide to move the trial to another day despite delays by the prosecution to start the trial ?
2. Are the witness to the prosecution (in this case the police officers), allowed to see the defendant's evidence before the trial?
3. If I collect further evidence in support of my position, am I responsible for proactively providing them to the Prosecutor? can he stop me from presenting those in the trial?
