My question involves labor and employment law for the state of: Nebraska, Illinois, Michigan
I'm a truck driver from the Detroit, MI. Until recently I was working for a company based out of South Sioux City, NE. This incident occurred in Illinois.
I recently decided to quit from my company and put in my two weeks. During those two weeks tensions escalated and I requested to be routed home immediately. They refused that request. I decided that I would drive the truck home anyway. They had a State Trooper stop me (I was not arrested or charged with any crimes), and a towing company came and took the truck.
While I was seated in the front passenger seat of the State Trooper's patrol car the driver from the towing company came to the window and I asked him when I'd be able to retrieve my personal items (roughly $1000 worth which included basically all of my clothes that I own) and he told me "Not until Monday morning." This happened on a Friday night. The state trooper was present during this transaction and it would have been recorded by the in vehicle camera system.
So the state trooper drove me to a motel where I rented a room until Monday. I called the towing company to inquire about when I could come get my things and they told me that someone from the trucking company had came and taken the truck on Saturday.
I called the trucking company and they told me, "Your stuff will be in the brown dumpster out back." I told them I was calling the police. They later sent me a text message that said I can arrange to have my belongings shipped back to me via an LTL freight company at my own expense. This is commercial freight and would be very expensive.
It is now Wednesday, five days after this took place and four days since the trucking company came and took the truck. I spoke to them on the phone today and they said they don't know where my personal belongings are, that it's possible they have been disposed of, and that their truck has not yet been back to the terminal. So either someone is driving around in the truck with all of my personal belongings, or someone threw them out and I won't get them back.
