My question involves a traffic ticket from the state of: California
I live in gated apartment complex where the parking laws are clearly stated in lease contract. Cars should be registered at the office to get the permit and without a permit visible, cars will be towed. Very simple rule. NO assigned parking. First come, first serve if you have permit. Only 1 max permit is given to a household regardless of the size of the household. Since our apartment only have 2 beds 2 baths units, there are many households that they have more than 3 cars. One silly thing is that the permit is not a sticker type, you just hang it on the back mirror. So I knew that many of my neighbors transfer the permit from car to car because, you should pay for additional parking inside the gate, and there are not many spaces outside of the gate to park cars. In other words, there are plenty of spaces to park inside the gate (it is just a matter of you walk a little far or you just walk for seconds. No matter what, you will find a space to park for sure) but there are very limited spaces outside of the gate. The security guard who patrolled over the area, supposed to enforce the parking laws, has no access to check whether that car is registered or not. He only can see the permit visible.
I am 60 years old and we only have 1 car in my household. 1 permit is enough and No issue with parking at all. There is a security guard who patrolled over the area, but seems like that he doesn't do his job, which is supposed to enforce the parking laws. I've seen more than 3 different cars without permits, parked just in front of my unit, over night, without being towed at all!. But since almost everybody is doing this sneaky trick (transferring permit from car to car), nobody ever complained about it, I thought I should be mercy, too. Walking a little distance was not a issue with me at all. I was ok if I can find out a spot to park inside of the gate. So, I didn't make this issue out. Here is my silly mistake comes. Yesterday, I had a very special guest visit my house for the dinner. Since it was a after hour visit and unexpected, I could not notice the office and get the guest permit for him and I could find out a space to park my car outside the gate with luck! So, I decided to park my car outside and took my permit away from my car to have this guest come and park inside with the permit. At 1130 pm, after he left, I came outside (I thought that parking my car outside would be dangerous..) and park my car inside the gate but totally forgot about putting back my permit!!! I woke up in the morning at 7 am and found out that my car was towed earlier at 3:40 am!!
It cost me $320!!! 155 for towing, 60 for gate fee (it was early in the morning), 45 for the storage and 60 for the labor. Don;t know why, but they towed my car from Anaheim to Los Alamitos, which was 9 miles away!!! How come they tow a car from Anaheim to that far? There is a towing company within a mile...And a very sad thing is that I found out that some resident reported my car to the security guard to call the towing!! The security guard didn't provide me who was, but he said that some resident called...Even though My car was registered, he could not access to see whether it was registered without visible permit. It was my big mistake and I should pay for it. I just felt very betrayed and sad. I was just too mercy, unnecessarily, not reporting any of these cars without permit, which took the spaces closer to my unit, led me walk far!!! From now on, I will protect my right. SO, my question is
1. Can any residents report the unauthorized car (in my case, the car without parking permit visible) to the surveillance (who is the security guard, hired by the owner of the property)to have him call the towing company and sign on the paper to tow? without giving his own Identity?
2. Can a towing company tow a car from Anaheim all the way to Los Alamitos? who picks the towing company? is there a written contract between the leasing office and the towing company? Is there any restriction to stop them from unnecessarily charge customers like in this situation? I really do not understand why they called the towing company in Los Alamitos.......I live in Anahiem and there are tons of towing company out there..
