My question involves estate proceedings in the state of: Fl
My father is near an end of life situation with an illness. He still has all his faculties but our family is unsure if he has done the proper planning for his death.
He has a living will as well as a regular will that is registered with the courts that basically states the beneficiaries of his life insurance and who he wants to get Various possessions that really have no monetary value, just sentimental. His only assets are some equity in his auto, a couple small balance checking accounts, and about $50k in a scottrade account. I'm the executor of the will( his son) and our family isn't arguing or worried about what little he has. We just don't want it to get taxed or go to lawyers if not necessary. Does he really need this will, and would something else less formal work better for him and for the family after he is gone?
