Adoption of Children: Can a Father Seek Custody if You Try to Terminate His Rights for Stepparent Adoption

My question involves adoption law for the State of: TX

I'm looking to have my husband adopt my child. Bio dad is on BC but is absent (his choice.) I barely knew him when I got pregnant, during the pregnancy I found out he did heavy drugs, and alcohol (I witnessed it) and he wanted to force me to abort. He physically assaulted me because in his words "to try to make me abort". Since then, I broke off the relationship. A week after my child was born I called him to sign the birth certificate and meet his child. We met at the registry office, he signed the BC and I was accompanied by a family member to ensure my safety. He met the child for less than 5 minutes, said it wasn't his and left. After that I kept trying to contact him for child support/visitation, regardless of my fear of him I figured if he met me with someone present he wouldn't be a threat to my safety. He kept refusing to agree to anything and said that if i dared sue him for any of it he would kidnap my child and hurt the child as revenge. At that point I was scared so I started trying to contact his family, they told me to stop calling. Eventually their phones were cut, sperm donor disappeared from the picture and it's been 8 years. I don't have any contact, have had any financial support from this person, and I'm afraid for my safety when it comes to him.

My questions are... When I sue him to revoke his rights for a step parent adoption, and if the courts do find him, out of spite, can he fight me for custody and have rights? Can I bring up to attention to the judge his threats and how he has assaulted me before even though I don't have a police report? And how can i prove to the courts that he did drugs/alcohol? Also my child has disabilities and I don't want any emotional turmoil to compromise the stability/emotional wellbeing considering the diagnosis says any changes/stress causes developmental regression. If he does appear, can I file a restraining order to ensure our safety?

PS. I am being as honest as I can be, this is a difficult subject for me to talk about. Thank You!
