My question involves estate proceedings in the state of: Oregon
FIRST OF ALL THANK YOU FOR TAKING THE TIME TO READ THIS, ANY SUGGESTION AND/OR ADVICE IS GREATLY APPRECIATED MORE THAN WORDS CAN EXPRESS SO THANK YOU VERY MUCH AND GOD BLESS!!:~}:~} I need to know the process of obtaining through the courts permission to access Granna's bank records and medical records.
SITUATION:
my great great grandmother {"GANNA} passed away Jan of this year, my mother had power of attorney, and was also added on to grandmothers bank account. no probate court, no will no assets, sadly the most valuable thing Granna owned was a fake pearl ring & bracelet worth about $30 bucks, a pair of winter boots, a pair of walking shoes 5 pairs of pants, 8 shirts, 7 pairs of underwear, 3 pairs of socks & a hair brush. My mother is a heathen F*** stain, she hawked, pawned and sold everything worth value years before Granna passed away. My mother has a gambling addiction along with a pill and meth addiction
In 2013 Grandma's AL timers started getting bad, so she gave power of attorney to my mother, and mother being the wonderful woman she, was "O" so happy to have full control over grandmas bank account. where her monthly SSI check would get deposited in the amount of $980.00 a month.
My mother is controlling and abusive, the investigating officer said the bed soars on my Granna were extensive, and the guy who rented a room to both Granna & my mother said Granna hadn't been out of her room in 3 months. My mother likes to break you down by taking away the basic things in life that have the ability to put a smile on your face, sunlight, clean clothes, fresh air, a letter in the mail from a family member, etc....
Granna's Death certificate reads natural causes but than continues to say extreme significant underlying cause of death HYPERTENTION~ INIANIATION~ AND NEGLECT.
The district Attorney said their isn't enough evidence to charge my mother with neglect or elderly financial abuse. After informing her that my mother had power of attorney for Granna and monthly income between the both of them was $1670.00 that my mother was on section 8 housing & her rent was $230.00 a month, that she had 11 eviction notices from 2013 until 2015 with the 11th notice resulting in eviction, and their electric was shut off on Feb 25th 2015 they were evicted on March 5th 2015 the outstanding electric bill was in the amount of $560.00 with the highest bill being $110.00{in a six month period}
The District Attorney said if I could somehow provide bank records showing were my mother had taken out loans to cover rent, provide records of the electric being shut off prior to the eviction and the outstanding bill being grater than $150.00 {I all ready have electric bill statements} along with medical records showing Granna hadn't been to see her doctor in years and was fired from her medical provider for to many appointment booked and no shows that then she would go forward and charge my mother for elderly financial abuse and possibly neglect.
So I need to know how I go about petitioning the court for legal permission to obtain copies of bank statements and records, along with having access to Granna's medical records.
