My question involves criminal law for the state of: any state
If A applies for a warrant by swearing in a formal written criminal complaint that "B shot C in the head" and that statement is neither perjury nor based upon information and belief, did A actually see B shoot C in the head? In other words, is A an eyewitness to the crime he alleged in his complaint?
