I'm European citizen, though I have been using the services of the following American company for hosting a website.

They have under-performed for years, though it was not until their extreme unresponsiveness lately got to my nerves that I decided to change to another service provider: my site could be down for 3 days in a row and not receive any reply from their customer service.
Their uptime is "guaranteed" to be 99.9% though I have records from a 3rd party website (http://ift.tt/Sq71qF) that show otherwise.
They don't appear to have any record of the uptime of their service.
I have asked them a refund for the months that have under-performed, though instead of discussing the matter they have just ignored me.
I would like to know which are my alternatives in this scenario.
