My question involves labor and employment law for the state of: California
My doctor suggested working from home due to issues related to pregnancy. I brought this to my HR depth and asked about work from home and was told my departmental boss banned working from home across the department. I know this is untrue because 5 people work from home and have since after his so called "ban". Working from home is allowed company wide for most positions with the exception of lab positions which cannot be done from home, however two of the five who do work from home have very important technical/lab responsibilities.One of the two technical employees comes in office one day every two weeks just for a meeting and then leaves. I am strictly administrative and do not fall under any of the telecommuting restrictions for our department. I work as the admin person for the entire department and the applications to work from home come through me to give to him (however he has since handled the 2 technical ones himself without including me since my request for telecommuting) so that, plus confirmation from HR when I brought it up is proof that these people telecommute.
My request was considered denied and I just had to miss work and pay off and on for months. One HR rep also told me that even if I did work from home I would be considered a liability to the company if I were to slip, fall, etc. So I guess me doing that in office or the other work from home employees getting hurt at home is different? When my condition worsened 2 months later, I got a second doctor to evaluate me and who recommended I work from home and sent a note expressing that I should be telecommuting. HR then stated that I would need a more detailed note after telling me the first time I requested that I just needed my doctor to say "work from home required". It's getting close to my due date ( over a month now) and now I think they are just stalling until I can't even work from home. The department head lied flat out. I have that in an email from HR when I first requested work from home. It has just been added stress for me and I feel I am being purposely treated unfairly.
The company is large with over 1000 employees and follows the FMLA/Maternity Leave laws.
Do I have any legal grounds to bring this to court?
