Civil Rights Issues: Can I Sue My Son's School for Trying to Fabricate a Case Against Him

My question involves civil rights in the State of: Florida

My son used to be in the "Special Education" program, diagnosed as "high functioning" with "autistic tendencies". That was back in elementary school. He improved grades and got placed on the regular diploma program back in middle school. Now in high school, his grades have dropped dramatically and the school is putting pressure on us to place the kid back on the special education program.

In February, there was an incident at the school where the special ed teacher reported to the school's deputy that my son was was "writing text messages about moving weapons and ammunition to his post at the turnpike". The deputy called the local police station and send some officers for a well being check. Turns out my son was still at the school, so the police ended up going there and questioning my son about said text messages.

According to the report I obtained at the police station, my son explained this were not text messages, they were snippets of a soldier's story he's been working on. I am aware of this story, I've read it. Some parts of this story appear quoted on the police report.

On the report it is also stated that the teacher was "concerned" because my son was "autistic".

I believe that the special ed teacher at this high-school had no business dealing with my son, since he is not on that class. I understand that this teacher had no right to search my son's phone, nor to make copies of a document stored on said phone. I believe the teacher copy-pasted portions of the document and maliciously reported them as "text messages", to get my son in trouble. And I believe my son was discriminated against for having been labeled "autistic" back in elementary school.

As a result, my son has now police reports with his name on it, and it's afraid of writing anything else.

What are my chances of taking this to court?
