My question involves a traffic ticket from the state of: WASHINGTON
Hi Washington State experts! I have been reading with this forum for a while and I hope I have picked up some things that can help me in this matter, but I wanted to present my ideas to you, since you are the experts and ask for advice from any of you.
At the time of this infraction my son was driving the car. He told me I would be receiving this ticket, so I have been expecting it.
I know that I can sign an affidavit that says that U was not operating the vehicle at the time of infraction, but what I don't know is if I should use the one provided for me, and if I don't use that one, do I need to contest the ticket and then produce an affidavit I made myself.
The Affidavit that they provide for me to sign includes a space for the name of the actual driver that was operating the vehicle. I don;t want to implicate my son in this, but I'm not sure if I can leave it blank, or write something like "I was not Present, thus I am not sure."
From what I have read of RCW, I understand it to mean that I only need to say I WASN'T driving, not that I know WHO WAS driving. RCW 46.63.075 "if the registered owner states, under oath, in a written statement to the court or in testimony before the court that the vehicle involved was, at the time, stolen or in the care, custody, or control of some person other than the registered owner."
In addition, I read a post by someone on this forum a long time ago, that the placement of this speed camera isn't lawful based on RCW 43.63.170. I know that would only come into play if I decided to contest the ticket with a hearing. My main question is about the Affidavit thing; if I need to use theirs or what I should say in that field.
I have attached pictures of the ticket and the options for it which include paying it, signing the affidavit, or scheduling a mitigation or contested hearing.
