I received an honorable discharge from the Navy in 2004 after about 18 months of service. I was given a RIF discharge to let me out after being the victim of a sexual assault from a superior. I was given basically no assistance and they just let me out. In 2009 I applied for disability benefits from the VA. They awarded it in just a couple of months at 70% for PTSD.
In 2012, I reapplied to get the temporary 100% based on my symptoms. I was awarded back pay from 2009 to 2012 at the 100% level. I have since gone through a lawyer and he is drafting a case to have my honorable discharge changed to medical retirement.
If the Board of Naval Corrections approves my medical retirement, how will that effect my benefits? Will I get any pay for the gap from 2004-2009, or will I receive any type of additional pay going forward? I know I get some additional benefits, like being able to get onto base, but I am confused as to how the pay works.
