My question involves a consumer law issue in the State of: Florida
We dropped our 1 year old dodge ram 1500 truck off at the dealership for service of an oil change and tire rotation and when completed we picked it up and we were driving home. 5 minutes after leaving the dealer my rear wheel came off and passed me on the road going thru a large intersection and into a Bud Chicken parking lot. Luckily no one was hurt or any further accidents caused. My truck landed hard on the rear brake rotor and axle since I was going 45 mph at the time. I had just gone over a RR track which bumped the tire enough to cause it to come off since the lugs were either not tightened or not put back on. I called the dealership they admitted negligence and sent a tow truck. By the time we got back to the dealership which was only a mile back up the road the 1 week old employee who worked on my truck was already fired and gone. Here's the issue. The dealer has repaired the truck and say it will be good as new. However they had to cut the left rear quarter panel out and weld a new one in to repair the damages to the truck from it landing on the side and now I have a truck with prior repairs. We also asked for lifetime warranty that dodge sells and were told that they could only get an 8 year warranty. We were sold an extended warranty from the dealer and just found out it was not a Mopar but an aftermarket warranty and they want us to cancel it and give them the proceeds and they use it to buy the 8 year Mopar warranty. At this point we just want the value back for it now being a repaired vehicle (which the dealer admits there is a diminished value) and lifetime service since it landed on the axle which they say is fine. What should we legally be entitled to and ask for from the dealer. All they keep trying to do is sell us a new car to fix the issue.
