My question involves a child custody case from the State of: Ohio
In my divorce, my ex and I agreed that child support would continue on our disabled son until he was 21. This was written into our decree and adopted by CSE, who lists his emancipation date as his 21st birthday. His father stopped working full time and works a minimum wage job, 15 hours a week. He attempted to have his support reduced, and this was denied. He appealed and lost. Now, his father has refiled with the court (not through CSE) to stop paying child support for our son, who he labels as his "fully emancipated, adult son" because he is over the age of 18. How do courts view children with disabilities in regards to child support?
Other relevant information:
I am in the process of obtaining legal guardianship of our son, but had to wait to start the process until he was 18, which just happened.
Our son receives no SSI or other payments from the government.
