My question involves a child custody case from the State of: Michigan

Child support has been paid up to do date, their was arrears but it was worked on all monthly support was paid (arrears was from being retro'd). Anyway, the person paying child support has ssdi, and received back pay for quite a few years causing a large lump sum. Children's custodial parent filed for children to receive their pay which is good. Since child support was up to date *arrears were paid way before she filed for back pay for the kids as well* can the children's back pay be used for future payments due to over payment of child support, since those payments were never considered into child support, since FOC never knew what the amount would be.
SSDI attorney said it is considered double dipping... anyone have experience with this as we have filed a motion about this and the court does not seem to know where to go with it.
