I have a question regarding a claim about a lane change accident. Let’s say Car 1 wanted to make q left lane change and the driver looked left and used the mirror and didn’t see any cars so she made the lane change. Suddenly she felt the impact of Car 2 hitting her in the rear. car 2 hit her and also swerved and hit Car 3 before stopping. the driver of Car 2 says that Car 1 abruptly turned in front of him and he didn’t have time to avoid him. I am the adjuster and determining liability but I am a little unsure. Car 2 was definitely speeding, which might be why Car 1 didn’t see him and why he had so much velocity that he hit 2 cars and not just 1. But driver of car 1 should’ve been more careful. If you had to deeermine liability, what would you say as far as % of how much each driver is at fault...?
