Determination of Fault: Rear-Ending a Vehicle Stopped in the Roadway Around a Curve

My question involves an accident in: Virginia.

on my way to work one morning- I came around a curve in the road and there was a car stopped right in the middle of the road. Right in the merge lane- completely stopped. I could not avoid him and I ran into the back of the car. My airbag exploded and I was taken by ambulance to the hospital. Later an officer came and said she was charging me because I ran into the back of the other car.

I asked if she had spoken with the witnesses and she stated that she did not know that there were witnesses. I asked if she knew why they had been stopped in the middle of the road. And she said that she was not aware that they had been stopped in the middle of the road. In fact she told me that no one was even on the scene when she arrived except the other driver. Later I requested a copy of the accident report and found that the officer had written that I was going 35 miles an hour and following the other car too closely and ran into them. This is simply not what happened at all. When I called the officer and asked that she correct her inaccurate report she told me if I thought I could beat it then go to court.

I have hired an attorney and we will be going to court about the ticket. But it has since come to my attention that the information that she gave me about the other driver is also not true. The man that I saw driving the car was older, probably late 60's or early 70's. The info that she gave me puts the other driver at 45 years old. A witness at the scene told me later that the older man driving the car called his son and that the son came to the scene. The witness at the scene said that the son did appear to be around 45 years old.

I believe that they used the son's drivers license and information when the female officer arrived on the scene. Is that illegal? To lie to the police about who was driving? And to lie to the insurance company about who was driving? I feel that I have a right to know who the other driver really was. And why they lied about it. Does the old man even have a license? Do I have a right to know? I feel very strongly that the other driver was at fault for stopping in the middle of the road. I have no driving report at all, all I have is 5 good points which in Virginia is the most you can get and I have never in 56 years been at fault in an accident.
