My car was towed from a Sunnyvale, CA public shopping mall for violating 2 hours parking limit. When I went to pick up the car at towing agency, the guy gave me a written authorization form, which was missing signature (or any information) on person/agency who authorized the two. The guy at the counter told me that he does not has to provide me any information beyond what was already on the form. I had done research and I knew that I have rights to get that information. I felt it was pointless to argue with him at that point. I paid the fine and picked up my car.
Few days layer, I again contacted the towing agency and complained about not providing proper written authorization. The promptly send me an updated written authorization which has a information on person who authorized the two. The two was authorized by security company which patrols the mall. However, the form was digitally signed and it did not has any time stamp. It seems very generic. There is no way to tell whether the authorization was given prior to towing.
I also noticed that tow was authorized at 7:11pm which was same as car first observed being parked at the mall. My car was towed at 9:20pm. I parked my car around 6:30pm so there is no way two can be authorized at 7:11pm. I called the security company who authorized the two and they told me that they trust towing company to ensure that car is not parked for more than two hours. Upon further inquiry I found that towing company patrols the parking mall and take pics of the car. Then they come again later and if the vehicle is parked for more than 2 hours they tow it, which seems illegal. They had taken pic of my car at 7:11pm. I asked the towing company to tell me when the tow was authorized and they are not responding to my emails/calls.
I think my car is towed without written authorization but I don't have substantial proof. Towing company is not telling me when the two was authorized. What are my options at this time? Should I take them to small claims court? Do I have a good case? Can I dispute the case without taking them to small claims?
