My question involves a parking ticket from the state of CA, I know this has come up a lot of times but here we go again:
I was cited for violating 22507.8:
"It is unlawful for any person to park or leave standing any vehicle"
By CVC 463:
Park or parking shall mean the standing of a vehicle, whether occupied or not, otherwise than temporarily for the purpose of and while actually engaged in loading or unloading merchandise or passengers.
I had my first appeal, the judge was very rude, and refuse to listen to me, she just straight out say I cannot so much as to touch the blue line ever even temporarily, I cannot have my wheels entering the disable parking space, I cannot even use it to do a 3 point turn, nor can I wait in front of an empty parking space to wait for another car pulling out from a normal parking space.
I had no intention to park there, I was just picking up my friend and was about to pull out when I was cited, and I will never take this privilege away from our friends that need special care.
However when I asked the judge where I can read about the detail she referred to me, she was very rude and said I just have to know this.
I read the DMV handbook again, and all I can find is:
"BlueParking is permitted only for a disabled person or driver of a dis-abled person who displays a placard or special license plate for disabled persons or disabled veterans. Disabled people with a placard or special plates may park in special areas for unlimited periods of time, regardless of time restrictions. A crosshatched (diagonal lines) area adjacent to a designated disabled parking space is a no parking area."
How does one know that we cannot even enter the "forbidden zone" according to her definition, or is she simply making up laws by her own free-will & understanding?
If we allow legal system to freely interpret laws as such, then it will become very dangerous.
I am going for a second appeal, and not sure if anyone here can give me some advice.
