Hello, I rented a car from a national car sharing company, the brakes failed while driving, as a result I crashed the car. Based on limited online research, the car type that I had was recalled last summer for brake system failure issues. The airbags did not work after impact. I did not hit another car. I have one witness (a security guard), possibly CCTV footage and pictures of the damage.
I understand a few years back, Congress affirmed that rental companies have an obligation to keep their cars in good working order, with a new federal law that requires them to repair problems with vehicles that are the subject of manufacturers’ recalls before renting them, hence a possible claim for negligent entrustment.
Advice and questions welcome. What options are possibly available? Thank you
