My question involves a consumer law issue in the State of: California
We took our Range Rover SUV (purchased in full brand new custom ordered in 2015) in for a warranty recall at a dealership in Santa Monica 7 weeks ago. However, just half an hour later, they called and told us they rear ended our car whole the technician was backing up into a column. They told us it's just replacing the bumper and back left light and they'd be responsible for the repair and gave us a loaner. Nevertheless, they were very unresponsive throughout the whole process. I asked for pictures of damages, none was given. We asked if Carfax would be reported, no response for a week. No one updated us with the damages the car has incurred or when or what they're doing to the car, except when I called the body shop they told us that before they begin any repair, they would give us an authorization of itemized repair before they do any work on the vehicle. Voice mails and emails were sent to Service Manager and General Manager, they simply ignored and avoided us. We had to go down to the body shop ourselves 2 weeks ago, only to find out that our entire car was torn and taken out from after driver/passenger, since they found out there are inner structure damage underneath the quarter panel plate. The repair was $15,000+. None of this is communicated to us even until this day, they did not update or call or provide us with any documentation. After numerous failed attempts to get the GM to respond to our financial compensation of $5k (for Carfax report when we sell the car) and extended warranty (for 70% of the car being torn apart), we left reviews on various social network. The very next day, their garage keeper liability agent finally contacted us, and offered us $6,500, and told us our car will be ready tomorrow and we have to go get it. However, we were very dissatisfied with the way they are avoiding and hiding the damages to our car and that the repair started even without our authorization, like it is not even our car.
Prior to this incident, our 2.5 year old/ 20k miles car was completely scratch and accident free.
Now my concerns are:
1) tinted Carfax report
2) the car is never same now they've taken out so much of the car.
My questions are:
1) can we refuse our car since this whole process has been so purposely hidden from us? How do we know what else is damaged?
2) can we have them buy the car back since the damage has extensively affected many other parts? What are my options?
