My question involves criminal law for the state of: California.
My boyfriend buys and sells cars as kind of a side hobby. For the most part he keeps on the right side of the law, but occassionally he will do something stupid like sell a car without a smog certificate, or one he doesn't have a clear title for. (He title-skips so he doesn't have to put his name on the transaction and pay the title fees.) On rare occassion he does things that aren't completely above the law. Now this woman who he sold a car to is trying to take him to small claims court.
My boyfriend is, of course, being super-evasive. (He's not listed on our apartment lease, so when the cops came to serve him with the small claims paperwork, he just hid and I told the sheriff I didn't know him.
After the sheriff left I asked my boyfriend how this woman even knew our address and apartment number (it is a huge apartment community).
He responded, "she must've somehow gotten it from the phone number."
I hadn't even thought of that! My boyfriend and I are on the same wireless family plan. I'm the primary account holder and when you Google his cell phone number it links back to my name/contact info. We live in same apartment complex as where he sold her the car so it was pretty easy for her to put it together.
Can I be held liable, or get in any trouble for his actions, for what he did while using one of "our" phones? I'm just worried this woman will contact me or try to serve me. What do I need to do (besides get a new boyfriend) so I don't get in trouble?
