I have a lease with a roommate, joint liability, and for the last month's rent before the lease ends the roommate failed to pay. He is essentially living with his gf. He claims he'll pay and has failed to do so. By the end of our lease I expect him to owe me over $1k. I have documents to prove he failed to pay and i that did. I intend to take him to small claims court, so i'm wanting to make sure i take actions that will not harm my case. Move out has not happened yet and he has possessions in the apartment, items of value and I intend to get the deposit back, am i in the right to remove said possessions in order to totally vacate the apartment or should i leave them in and file for whatever is lost on the deposit as well?
