My question involves a consumer law issue in the State of: PA

Long story short, my family has owned a plot of land for 25+ years. In the early-mid '90s, it was apparent that water run-off from an adjoining property was an issue on our property. In the mid 60s, a drain was put in (by the offending land owner) on the corner of our property (the low point) as an easement was granted at some point in the 50s.
Anyway, the drain is useless. My family established records of the water run off over a period of 3 years. Land studies were done privately at my family's expense, given that the township would not pay for them. They didn't feel they were necessary since the road being washed away was a private road. Long story short, providing all this evidence and numerous petitions to the township council has done nothing.
About 3 years ago, a new owner took over the property in question. Prior to that, the building on the property served as a school, and the lot was designated residential. Somehow, a commercial business now exists, even though there was no formal change to the zoning. Substantial land changes were made, along with grading issues and construction. In the opinion of my FIL who is a civil engineer, those improvements are now causing additional water runoff.
Our problem is that every 1-2 years our road gets completely destroyed due to this run off. We've tried to remedy the situation with make-shift channel drains and other grading attempts, but have been unsuccessful.
Does anyone have any advice on remedies we can seek or other ideas on how we could resolve this? Honestly don't know where to start or if it's just something that has to be "dealt with". Thanks.
