My question involves landlord-tenant law in the State of: Nevada
HI, I recently moved to Nevada, and I am on section 8. I found a place that I loved, and I filled out an application, paid the application fee, and paid a security deposit. Not once was the security deposit called a holding deposit, I was not even made aware that my application was approved. I say this to say, I never signed a lease, and also when I paid my security deposit, I dropped it in the drop box, so i never even got a receipt, only the one that came from making the money order. With all of that being said, since I am on section 8, I found out after all of this that the place was out of the income restrictions making me unable to move there, so I informed the realtor of this and now she is saying that my security deposit may be non refundable because she took it off of the market, and if she doesn't find someone by November she has to keep it. I am19 years old trying to rent my first place, Im unsure if it's common knowledge that I would not be getting my security deposit back, or since I never signed nor formally agreed to obtaining residency that I really am entitled to receive it back? As stated i just moved here, I've been working since the age of 16, but currently I am looking for a new job since mine did not transfer with me. Meaning I am reliant on the money so that I am able to pay a security deposit elsewhere since I currently have no income. Any advice and information is greatly appreciated!
