My question involves a child custody case from the State of: Virginia
I am trying to keep it short. I found out my exes income almost doubled this year compared to 2015 and the year isn't even over yet. In addition, my daughter switched daycare in February (because I moved) and the cost increased $193 a month. The previous daycare cost was actually already lower then average for my area as the lady gave as a really good price. Anyway, I requested a review and my exes child support increased by $482. I was really surprised but that as I was not expecting it to be this much. Now my ex appealed the order and consulted with a lawyer. He told me we will have to go to court. My ex asked me a few things that kinda got me thinking. Here are my questions.
I go to school part time and work full-time. I receive Grants and school loans. Most of the Grants are used to pay the amount I owe the school for books and tuition. I receive whats left, like this semester it was a little over 600. Does that count as income that I need to report? How about school loans? I receive about 5k in sub and unsub school loans which I have to repay. Does that count as income I need to report? I don't have a problem doing so I was just not aware of it and I cannot find anything online.
My second question and biggest worry is the childcare. My daughter started the new preschool in February. It is work-related preschool as she is there all day while I am at work. My ex said that he has a say in where she goes to daycare and he will have her switch daycare to decrease his obligation. She is only 3 so a switch is really stressful for her right now. In addition, we love her preschool. Its perfect for her and for me location wise. Using an online child support calculator shows me that a lower cost for daycare will barely change the amount so I am more then happy to take less money as long as I can keep her in that school. Can my Ex really make her switch daycare? Would a judge agree to that?
I have sole custody, not by court though. She is with me every night and sees her dad Sat and/or Sun during the day. I also pay all of her medical insurance and any medical bills. He is fighting the new order because of hardship (so he says). Should I also get a lawyer? Money is really right because I am the one paying the 20k debt we collected while being together and being young and dumb.
