My question involves real estate located in the State of: Washington,
We have a corner lot that was part of a subdivided section which made 26, 5 acre parcels.
We have 5 of those parcels in the corner and have had it surveyed and recorded with the county as one unit.
In doing so we have found that the original survey map that had a easement drawn on it was never completed or done to the county standards.
Their standing is the easement is not valid and is just lines on the paper. They use the record map as a listing for parcels for tax info only and nothing more.
So our recorded map does not show the easement line from the previous survey.
The driveway is on our property and it goes along the north edge for the length to the adjoining parcels.
This driveway is approx 20 feet wide and everyone uses it to come and go to their land.
We have had many problems with a few land owners about our placing a fence up (we have free range horses during the day) and the placement of rocks along the fence because of an idiot that will drive into it and drag it down. because its squeezing in his driveway. He has property way away from us but uses this entry point.
Can we close off the driveway for others to use?
This narrow passage way is the only access to get to the other parcels of land from the first survey that split the section into 26 pieces.
So in blocking it off they will have no way in or out.
Per the county there is no recorded easement or right of way on our parcel.
Tired of repairing the fence and being told what we can and cannot do with our land.
What can they do if I block it?
