DNA Testing: When Is It Too Late to Request a Paternity Test

My question involves paternity law for the State of: TexasSo, about 4 years ago, my ex-girlfriend gave birth to my daughter. We had broken up before the birth and she got married. She gave birth while I was at a job I was unable to leave and I had no idea where to go if I did leave. The husband signed the birth certificate.

It turns out that he was allegedly abusive to her, and according to my ex, said some vile things to her and about my daughter.He made it impossible for her to contact me, and vice versa. Now 4 years later after their divorce, she's finally coming into contact with me again. Sending my pictures of my little girl and even introduced me through FaceTime. The bad part is, my ex girlfriends mother has custody of the kids. (She has a kid with the ex husband whos currently in jail). My ex, (we will just call her Jane) wants me to be in my daughter's life. but her mom doesn't.

Jane is willing to testify that I am the biological father in request for a paternity test so I can move forward with child support and finally be in her life. Please tell me it's not too late or that there's a loop hole I can work through. All I want is to be in her life.
