My husband entered the US legally in 2004, got his green card in 2013 but also in 2013 got a drug charge. They gave him probation for 12 months. Ice picked him up and he was held without bond for about a month. The jusge granted him a voluntary departure so he left the US. I am a USC and we have 4 children. He has never been in trouble before this incident and was in the US for 12 years. We were planning after he completed his probation to expunge the case but all of this happened. He was not given a "ban" but we were wondering if he is applicable for the I-212 along with form I-601? i have tried doing as much investigating as i can but he does have strong ties here in the US with myself and the children involved. Any suggestions?
