My question involves a child custody case from the State of: Florida
My daughter is 16 months. Her biological father goes a week to three weeks without seeing her. I get little to no help financially from him. He will ignore my calls and texts for days.
Never married. Never been to court , never established custody or parental rights. My boyfriend has been more of a father to her and involved 100% since she was 3 months old. He has better lifestyle opportunities for us in Upstate New York.
my question is... Can I move to New York with my daughter?
We would have to live in New York for 6 months before we would be able to file for custody in New York.
I fear with living in florida that it would take a long time to go through the court process here in florida. And I do agree with visitation. But then we would be stuck here in Florida.
some back ground story. for the last two months. I have screen shotted all and every text between me and her biological father, his name is his phone number/full name. I then send the screen shotted texts to my email. To verify the dates.... I have also been logging a journal of any visitation between my daughter and him, and details about the texts, and current conversations. I take photos of my journal Entries and send them as of that day to my Email to verify dates, that it was in fact written when said. As of today September 20th, he has seen her one time. He over dosed on pills 6 months ago and still using illegal drugs. He lied about his occupation for 5 months, I went to bring him a letter at work because he ignores my calls and texts, they stated "we have never heard of this person before".
I fear for her safety when she is with him. He has stated through text that he "wants to kill himself". I have been on my best behavior, but I have texts of him cussing at me. As he has anger issues. I have messages from his birth mother, through willing conversation stating he has Anger issues, he refuses to get help for.... which I have politely asked him to seek out professional help.
I CAN NOT. Have a civilized conversation with him. He yells at me, cusses at me, and hangs up every time. I cant even get to a point of bringing up a move to New York because he flips out. He blames me for the lack of responsibility for his daughter, as I don't want to be in a relationship with him.
My boyfriend and I are more then ready to start a stable and good life for my daughter. In New York he has a studio apartment attached to his parents home who are willing to support us emotionally with Ember and getting our life together etc. Here in Florida, the three of us live in an RV in my mothers backyard, as 8 people live inside the house. My family yells and bickers a lot, and I don't feel its the best environment for a child. We plan on getting Married and building a home on his parents 80+ acres of land in Watkins Glen Upstate New York.
Her biological father picks and chooses when its convenient for him when he wants to be her father, her friend. And not Actually parent her.
I cant stay here for 1+ year going through the legal process hoping they allow us to move.
6 month in New York before the courts have legal jurisdiction, two months for the custody court case to finish.
