My question involves a consumer law issue in the State of: California
I purchased a 2001 suburban off ebay early this week from a private party in Oregon. Total price $6900. The description given on the auction was the car was in GREAT mechnical condition and near perfect in and out. When the car was delivered I did a quick once over and on the surface the car looked good. When I drove it some minutes later the AC did not work and there were other minor issues too. I called the seller and he said he didn't know of any of these issues but would try to help out on the repair of the AC which he stated worked when it left. I took it to a mechanic, guy I trust and know, who showed me how completely rusted the car was underneath and that the AC had imploded, was covered in rust and hadn't worked for months. There was a $1000 non-refundable deposit.
I called that same day and said I have to return the car it is not as described in the least and will cost thousands to repair. I want a full refund due to the deception perpetrated in the description not matching the vehicle. He refused and kept the $1000 plus kept $650 saying that's what it will cost him to transport it back to Oregon.
I'm out $1650, should I sue?
