My question involves a child custody case from the State of: texas
NCP is seeking custody citing that the children are educationally, socially, and emotionally neglected due to homeschooling. Kids have been homeschooled both at his house by his (now ex) wife when they lived with him, and by me since they have been with me (5 years give or take). He has never asked a single question about their education.
My issue is that the social worker assigned to our case was very anti homeschooling from the get go. During our home visit she witnessed the bookshelves full of textbooks and curriculum etc but refused to review any of their work, tests etc. She made derogatory comments about our church youth group, etc. and said I was incompetent to teach them since I hold no education degree. ( most of their work is done online through a variety of places and taught by credentialed instructors, I merely facilitate and make sure the work is done etc)
This has been dragging on for a year now. I've made 8 separate appearances, one being to force him to return my daughter after he took her and refused me any contact with her for 3 weeks until we finally had a court date, at which the judge (district- not the one hearing this case) simply told me to take her home. It has destroyed us financially. inisially the kids wanted to go there (grass is greener, things were promised) but they have since changed their tune but he refuses to let it go. One of the 2 is even 18 now and he still wont let it go.
should I be concerned that I will lose custody? I understand the burden of proof lies with him and he has none, but homeschooling still seems to have such a stigma, even though I can clearly demonstrate that the kids have been well educated. I feel like this whole thing has been done just because he is alone and bitter for being divorced again, shelling out alot of CS to multiple women, and I've been happily married for many years. He is emotionally abusive and manipulative and while he is relatively attentive to them when they visit him, he is not a parent, more of a friend. His choice and I realize that, but it is truly not the best environment, though the social worker feels that a single dad who travels constantly is better than a 2 parent sahm household simply because we have ideological differences. I'm just baffled.
do you think I have any recourse to even get my atty fees reimbursed? I am confident in my atty capabilities but homeschooling is a relatively gray area in these situations because it is unregulated in texas.
