Establishing an Order: What is the Likelihood I Will Get Custody

My question involves a child custody case from the State of: Texas

I have 2 children with the same man. We have never been formally married via ceremony or elopement. We have lived together 4 years, we file taxes together, etc. (How much standing does "common law marriage have in court room? Or does the fact he has played an active fathering role in kids' lives matter more to court?) I have been a stay at home mom during these four years. I have no career or income to speak of. All my savings I had when I moved in with him has gone into our household. He has been through divorce and custody with his ex-wife. He has 2 kids with his ex, of which he has always been the custodial parent. He is much more experienced in gaining custody and what looks good/bad in court as well as who is a good lawyer for the job. Not to mention he has a means of affording a lawyer, where I do not. He is very intelligent and well educated. I am terrified to leave him for fear he will take my kids away from me. Neither of us can be called bad parents. I just started going back to school for a degree in nursing (which of course he is paying for, because I have no personal income). He has recent charges of public intoxication and resisting arrest within the last year. I also have some misdemeanor drug charges for marijuana from 8+ years ago. I am only questing for any and all info I can find on relevant legal advice. He is not especially reasonable when it comes to communicating me and he can be very cunning and manipulative. So I absolutely do not trust that he will be civil or fair should I decide to pursue custody. I also have watched him co-parent/communicate with his ex for several years so I know some of what kind of behavior and thinking to anticipate from him, should we decide to split up.

This separation would not be happening quickly or anytime soon. Is there anything I can begin doing/acquiring to help my standing in the event I ever pursue full custody? What would courts be looking at?
