My question involves court procedures for the state of: NY
I filed a lawsuit against my former employer on Aug 1. They filed an acknowledgement of the lawsuit on Aug 9 with the intention to contest the lawsuit. Almost seven weeks have past, but they still have not filed a defence.
I would like to ask how do I go about entering a default judgement against my former employer.
Should I file an ex-parte request/affirmation to the Court and wait for their response or should I request an inter-parte hearing and ask the judge to grant default judgement at the hearing session?
