My question involves insurance law for the state of: California
I got into an accident with a drunk illegal immigrant driver (named A) who didn't have a driver's license. She was at fault. Police report and insurance companies agreeing on that. My property damages were about 5600, (my insurance paid 75% of the value, 25% remaining)
The person (named B) who actually owns the vehicle & wasn't in the vehicle at the time of the accident. He landed the driver the vehicle for the night.
Now the insurance says there's only 5000 on the insurance to be given out since the owner of the vehicle wasn't driving. ($950 for me and the rest for other parties claiming) To get the 950, they want me to sign a release of claim. saying that I can't sue person A or person B.
If it worth signing ? It will probably be hard to sue person A since she's 100% illegal. And I'm not sure if I can sue person B since he was not involved in the accident. (Besides letting her drive knowing she didn't have a drivers license.)
