My question involves real estate located in the State of: South Carolina
April of 2012 My mom and I decided to do a rent to own to Mr. Myers. Everything went through a lawyer (who is now retired). A Purchase Money Mortgage and a Special Warranty Deed was done. February of this year Mr. Myers passed away. The title was put in his name and we are listed as lien holder's. The family is refusing to open probate on his estate. I just want my house back, but I don't have thousands of dollars to fight all his heirs to get my house back. There is still a little over $39,000 due to fullfill the rent to own. Is there anything I personally can do about this and not have to hire an attorney being it's my house since he nor his heirs have full-filled the agreement. Also before Mr. Myers passed he moved is friend in the house. So now his friend is living there free and probably destroying the house. Can I do anything to get him out of the house?
Once again I don't have the money to hire an attorney unless they will fight it then take the money out of the settlement once it's sold. I live on a very small fixed income, so paying for an attorney is not in my cards. Is there anyone that can/will help me get back what is rightfully mine.
